Terms & Conditions
Last Updated: 13 April 2026
Welcome to FRED TOME.
These Terms & Conditions govern your use of the FRED TOME website and any purchases made through our online store. By accessing our website, creating an account, placing an order or otherwise using our services, you agree to these Terms & Conditions.
Please read them carefully before making a purchase.
1. ABOUT FRED TOME
FRED TOME is a South African fashion and lifestyle brand offering clothing, footwear, bags, accessories and related products.
For purposes of these Terms & Conditions, “FRED TOME”, “we”, “us” and “our” refer to:
Legal Entity: FRED TOME GROUP
Trading Name: FRED TOME
Country: South Africa
Email: care@fredtome.co.za
Website: www.fredtome.co.za
“You” and “customer” refer to any person accessing our website or purchasing products from us.
2. USE OF OUR WEBSITE
You may use the FRED TOME website only for lawful purposes.
You agree not to:
-
misuse, interfere with or attempt to disrupt our website;
-
gain unauthorised access to any part of our website or systems;
-
introduce viruses, malicious code or other harmful material;
-
copy, reproduce or commercially exploit our website content without permission;
-
use our website for fraudulent or unlawful purposes; or
-
provide false, misleading or fraudulent information when placing an order.
We reserve the right to restrict or terminate access to our website where misuse, fraud or unlawful activity is reasonably suspected.
3. PRODUCTS
We make reasonable efforts to display our products as accurately as possible.
Product photographs, colours, textures and proportions may appear slightly different depending on lighting, photography, screen settings and the device being used.
Minor variations in colour, texture, stitching, hardware, print placement or finish that are inherent to the manufacturing process may occur and do not necessarily constitute defects.
Product measurements and sizing information are provided as guides unless expressly stated otherwise.
Customers are responsible for reviewing the relevant product information and size guide before purchasing.
4. PRODUCT AVAILABILITY
All products are subject to availability.
Placing an item in your cart does not reserve that item.
We may limit quantities available for purchase and may withdraw or discontinue products without prior notice.
If an item becomes unavailable after you have placed and paid for an order, we will contact you and provide an appropriate refund or other remedy in accordance with applicable law.
5. PRICING
All prices displayed on our South African online store are shown in South African Rand (ZAR) unless stated otherwise.
Prices displayed at checkout are the prices applicable to your order, subject to obvious pricing or technical errors.
Delivery charges, where applicable, will be displayed separately before you complete your purchase.
We reserve the right to change our prices at any time. Price changes will not retrospectively affect orders already validly concluded.
6. PRICING AND WEBSITE ERRORS
Although we take reasonable care to ensure that information on our website is accurate, errors may occasionally occur.
If a product has been incorrectly described, priced or displayed because of an obvious technical or administrative error, we may contact you before processing the affected order.
Nothing in this clause limits any rights available to you under applicable South African consumer law.
7. PLACING AN ORDER
When placing an order, you must provide accurate and complete information, including your:
-
full name;
-
contact details;
-
billing information;
-
delivery address; and
-
any other information reasonably required to process your order.
Before submitting an order, you will have an opportunity to review your order and correct errors.
Submitting an order constitutes an offer to purchase the selected products.
Your order is subject to acceptance by FRED TOME.
8. ORDER CONFIRMATION
After placing an order, you may receive an automated email confirming that your order has been received.
An automated acknowledgement does not necessarily mean that your order has been accepted or dispatched.
We may conduct payment, stock, security or fraud checks before accepting or dispatching an order.
Once accepted, your order will be processed for fulfilment.
9. ORDER CANCELLATION BY FRED TOME
We may cancel or refuse an order where reasonably necessary, including where:
-
an item is unavailable;
-
payment has not been authorised;
-
fraudulent activity is suspected;
-
incorrect information has been supplied;
-
a material pricing or technical error has occurred; or
-
we are legally prohibited from completing the transaction.
Where we cancel an order after receiving valid payment, the appropriate amount will be refunded in accordance with applicable law and our payment provider's processing procedures.
10. PAYMENT
Available payment methods will be displayed at checkout.
Payment must be successfully authorised before an order is processed unless another arrangement is expressly offered by FRED TOME.
Payment services may be provided by independent third-party payment providers.
FRED TOME does not intentionally store complete payment-card details unless expressly stated and permitted by applicable payment-security requirements.
You confirm that you are authorised to use the payment method selected when placing your order.
11. DELIVERY
We currently deliver to locations made available during checkout.
Estimated delivery periods may be displayed on our website or during checkout.
Delivery periods are estimates unless expressly agreed otherwise.
Orders may be affected by circumstances outside our reasonable control, including courier delays, severe weather, public holidays, strikes, supply-chain interruptions or incorrect delivery information.
Customers are responsible for ensuring that the delivery address supplied is accurate and accessible.
Our delivery terms do not limit any rights you may have under applicable South African law.
12. FAILED OR INCORRECT DELIVERY
If delivery cannot be completed because incorrect or incomplete information was supplied by the customer, additional delivery charges may apply where permitted by law.
If you believe your parcel has been lost, incorrectly delivered or materially delayed, please contact care@fredtome.co.za with your order number.
We will investigate the matter with the relevant delivery provider.
13. INSPECTING YOUR ORDER
Please inspect your order as soon as reasonably possible after receiving it.
If you receive:
-
an incorrect product;
-
an incomplete order;
-
a damaged product; or
-
a product that appears defective,
please contact us promptly and provide your order number together with reasonable supporting information or photographs where appropriate.
Your statutory consumer rights remain unaffected.
14. RETURNS, EXCHANGES & REFUNDS
Returns, exchanges and refunds are governed by these Terms, our Returns & Refunds Policy, and applicable South African consumer law.
Where applicable under the Electronic Communications and Transactions Act, an eligible consumer may cancel an online transaction for goods without reason within seven days after receiving the goods, subject to the exceptions permitted by law.
Where such a statutory cooling-off right applies, the customer may be responsible for the direct cost of returning the goods where permitted by law.
Certain goods may be excluded from statutory cooling-off rights where permitted by law, including certain personalised, custom-made or otherwise excluded products.
Nothing in our Returns & Refunds Policy limits a customer's statutory rights relating to defective, unsafe or unsuitable goods.
15. DEFECTIVE GOODS
Products supplied by FRED TOME are subject to the protections provided by applicable South African consumer legislation.
Where a product fails to meet the applicable statutory standards of quality, safety, durability or fitness for purpose, customers may have rights to a repair, replacement or refund, depending on the circumstances and applicable legislation.
Normal wear and tear, accidental damage, misuse, failure to follow care instructions or alterations made after delivery are not necessarily product defects.
16. SALE AND PROMOTIONAL ITEMS
Products purchased during promotions or sales remain subject to applicable consumer law.
A reduced price does not remove a customer's statutory rights where a product is genuinely defective.
Where a product has been specifically discounted because of a disclosed imperfection or condition, that disclosed condition will not ordinarily constitute a defect where the customer expressly accepted it, subject to applicable law.
17. PROMOTIONAL CODES
Promotional codes:
-
must be used before their stated expiry date;
-
cannot ordinarily be exchanged for cash;
-
may be limited to specified products or customers;
-
may be subject to minimum purchase requirements;
-
may not be combined with other offers unless expressly permitted; and
-
may be cancelled where obtained or used fraudulently.
Additional promotional terms may apply to individual campaigns.
18. PRE-ORDERS
Certain products may occasionally be sold on a pre-order basis.
Where a product is identified as a pre-order item, the expected dispatch or delivery period will be communicated on the relevant product page or during checkout.
Pre-order dates are estimates and may change because of production, manufacturing, customs, logistics or other delays.
Where a material delay occurs, we will communicate with affected customers and provide the options required by applicable law.
19. INTELLECTUAL PROPERTY
Unless otherwise stated, all content appearing on the FRED TOME website is owned by, licensed to or used with permission by FRED TOME.
This includes, without limitation:

We may suspend or restrict an account where fraudulent, abusive or unlawful activity is reasonably suspected.
22. PERSONAL INFORMATION AND PRIVACY

You may unsubscribe from electronic marketing communications using the unsubscribe option provided or by contacting care@fredtome.co.za.
Transactional communications relating to orders, payments, deliveries, returns or customer-service matters are not considered promotional marketing communications.
24. WEBSITE SECURITY
We take reasonable measures to protect our website and customer information.
However, no internet-based system can be guaranteed to be completely secure or continuously available.
You are responsible for using appropriate security measures when accessing our website, including protecting your account credentials and device.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
25. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, FRED TOME will not be liable for indirect, incidental or consequential losses arising solely from the use or inability to use our website where such liability may lawfully be limited.
Nothing in these Terms is intended to exclude or restrict:

-
obligations imposed on FRED TOME by the Consumer Protection Act, ECTA or other applicable legislation; or
-
any other statutory remedy available to a customer.
26. EVENTS OUTSIDE OUR REASONABLE CONTROL
FRED TOME will not be responsible for delays or failures caused by circumstances outside our reasonable control to the extent permitted by law.
These may include:
-
natural disasters;
-
extreme weather;

civil unrest;
-
transport disruptions;
-
telecommunications failures;
-
power failures;
-
governmental restrictions;
-
customs delays;
-
supplier interruptions; or
-
courier network disruptions.
We will take reasonable steps to minimise the impact of such circumstances where possible.
27. FRAUD
We reserve the right to investigate transactions that appear suspicious or potentially fraudulent.
Orders may be delayed, suspended or cancelled while appropriate verification is conducted.
Fraudulent use of payment information, customer accounts, promotional codes or the FRED TOME website may be reported to the relevant financial institutions or authorities where appropriate.
28. CHANGES TO THESE TERMS
We may update these Terms & Conditions from time to time to reflect changes to our business, website, services or applicable law.
The version published on our website at the time a transaction is concluded will generally apply to that transaction, subject to applicable law.
The latest revision date will appear at the top of this page.
29. SEVERABILITY
If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated as severable to the extent necessary.
The remaining provisions will continue to apply.
30. GOVERNING LAW
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Nothing in this clause prevents a consumer from exercising any rights or remedies available under applicable South African consumer-protection legislation.
